Viterra USA, Inc. and its affiliates and subsidiaries (“Company”, "US", or “We”) respects your privacy and is committed to protecting it through our compliance with this privacy policy (“Privacy Policy”).

This Privacy Policy applies to your provision of information to Company, including, without limitation, in person, by phone, through mail or email or through the website www.viterra.us and other Company-owned and/or operated websites, mobile sites, mobile applications or social media account (collectively, our “Site”) and our practices for collecting, using, maintaining, protecting and disclosing that information.

This Privacy Policy applies to information we collect:

  • On our Site.
  • In e-mail, text and other electronic messages between you and Company that are related to the services that Company is providing you.
  • Through mobile and desktop applications you download from our Site or from applications marketplaces.
  • In person, by phone or through mail, including from parties that interact with Company directly (our customers or service providers, or other individuals that request information or otherwise voluntarily provide us with their information or otherwise consent to the disclosure of such information to us).

This Privacy Policy does not apply to information collected by any third party, including through any application or content (including advertising) that may link to or be accessible from or on our Site.

Children Under the age of 13
 

Our Site is not intended for children under 13 years of age. No one under age 13 may provide any personal information to or on the Site. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on our Site or on or through any of its features or provide any information about yourself to us, including your name, address, telephone number, e-mail address or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information.   • by which you may be personally identified, such as name, postal address, e-mail address, telephone number, customer identification number or any other identifier by which you may be contacted online or offline (“personal information”).

  • that is about you but individually does not identify you.
  • about your Internet connection, the equipment you use to access our Site and usage details.

Aggregated and de-identified information cannot reasonably be used to identify you and, therefore, no longer constitutes personal information. Such de-identified and/or aggregated information that does not identify individuals is not subject to this Privacy Policy.

We may keep your information for as long as is necessary for our business purposes, to protect ourselves in the event of a legal claim, or as permitted or required by law.

We do not perform processing of your information which constitutes profiling in furtherance of decisions that produce legals effects or similarly significant effects concerning  you. 

Customer Preference and Opt-Out Choices
 

We may also use your information to contact you about our services that may be of interest to you. If you do not want us to use your information in this way, please provide notice to Company through one of the following ways:

  • Adjust your user preferences in your account profile; or

Disclosure of Your Information
 

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction. Such information is not subject to this Privacy Policy.

We may disclose personal information that we collect or you provide as described in this Privacy Policy:

  • To contractors, service providers and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
  • To parties who provide website analytics.

  • With strategic partners who provide additional features on the Site. These strategic relationships may include business partners, sponsors and co-branded Site features.   • To fulfill the purpose for which you provide it. For example, if you sign up to receive email communications from us, we collect your email address and any related information you provide. If you sign up to receive phone or SMS text message communications from us, we collect your phone number and any related information you provide.
  • For any disclosure that would be reasonably expected by you. 
  • For any other purpose disclosed by us when you provide the information.
  • With your consent or at your direction.
  • As otherwise would, under the circumstances, be reasonably expected by a consumer. 

Regardless of your opt out or profile preferences, we may also disclose your personal information:

  • To enforce any agreement we may have with you.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Company, our customers or others.

In some circumstances we give you choices about the ways we collect, use and disclose your personal information. If so, we may ask you to indicate your choices at the time we collect your personal information. If you have created an account or a personal profile on our Site, you may update some or all of your privacy choices by changing the settings on your account settings or profile page.

California residents may have additional rights regarding the collection and disclosure of their personal information. Please refer to the supplemental notice for California residents found on our Site entitled “Privacy Notice for California Residents”.

Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request to: +1 (877) 346-1797 or privacy-us@viterra.com. However, please know Copmany does not currently sell data triggering this Nevada statute's opt-out requirements.

Accessing, Correcting, and Deleting Your Information
 

You can review and change your personal information by logging into our Site and visiting your account profile page. Account users may delete their user profile information by deleting their account. 

California residents may have additional rights regarding the access and deletion of their personal information. Please refer to the supplemental notice for California residents found on our site entitled “Privacy Notice for California Residents”.

Third Party Features
 

Our Site offers links to other third party websites that may be of interest to you. The links provided on our Site are provided solely for your convenience and may assist you in locating other useful information on the Internet. When you click on these links, you will leave our Site and be redirected to another website.

These third party websites are not under the control of Company and are not subject to this Privacy Policy. In using such third party websites please be aware that each third party website is subject to its own privacy policies and is not covered by our Privacy Policy. We make no representation or warranty regarding the accuracy of the information contained on such third party websites, and Company disclaims all responsibility relating to or resulting from your use of such third party websites.

Data Security
 

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. Our security measures include industry standard technology and equipment to help protect your personal information.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. Further, where you are given the option to authorize additional users to access your account, it is your responsibility to request removal of such user(s)’s access by emailing privacy-us@viterra.com once you no longer want such user(s) to have access.

Unfortunately, the security of transmission of information via the Internet cannot be guaranteed. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Site. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

Changes to Our Privacy Policy
 

This Privacy Policy may change from time to time. It is our policy to post any changes we make to our Privacy Policy on this page. If we make material changes to how we treat our users' personal information, we will notify you through a notice on our Site’s home page. Your continued use of our Site after we make changes is deemed to be acceptance of those changes. The date this Privacy Policy was last revised is identified at the top of the page.
